1. Acceptance of Terms
By engaging Christine's Travel Therapy ("we," "us," "our," "the Agency") to plan, arrange, book, or advise on your travel, or by submitting a booking request through our website or the TravelJoy client portal, you ("client," "you") agree to be bound by these Terms and Conditions, our Privacy Policy, and the terms of any supplier(s) whose travel products or services you purchase through us.
If you are booking on behalf of a group, family, or other travelers, you confirm you have authority to bind each traveler to these Terms.
2. TICO Disclosure Statement
Christine's Travel Therapy operates as a registered travel agency under the Travel Industry Act, 2002 and Ontario Regulation 26/05, under TICO registration number 5003057
We act as an intermediary/agent arranging travel services on your behalf with third-party suppliers (airlines, hotels, cruise lines, tour operators, insurers). We are not the principal supplier of these services unless expressly stated in your booking confirmation.
Certain purchases made through us may be eligible for coverage under Ontario's Travel Industry Compensation Fund, subject to the Fund's eligibility rules at the time of booking. Not all products (e.g., some travel insurance, or purchases made directly with a supplier) qualify — ask us if you're unsure about a specific booking.
A copy of our TICO registration is available upon request.
3. Our Role as Your Travel Advisor
We provide travel planning, sourcing, and advisory services based on the information, preferences, and constraints you provide us. While we take care in selecting reputable suppliers, we do not control, and are not liable for, the acts, omissions, services, or products of third-party suppliers — including but not limited to airlines, hotels, tour operators, ground transportation providers, and travel insurers. Your relationship with each supplier is governed by that supplier's own terms and conditions, which you are responsible for reviewing.
4. Bookings, Deposits & Payment
A booking is confirmed only once we have received your required deposit and any documentation requested, and the supplier has confirmed availability.
Deposit amounts, final payment due dates, and accepted payment methods will be set out in your individual Trip Reservation & Proposal Agreement and/or Invoice Payment Authorization.
Prices quoted are subject to change until a booking is fully confirmed and paid, due to factors including currency fluctuation, fuel surcharges, and supplier pricing changes. We will notify you promptly of any material price change prior to final payment.
Late or missed payments may result in cancellation of your booking by the supplier, subject to that supplier's own cancellation terms, and are not the responsibility of the Agency.
5. Cancellations, Changes & Refunds
Cancellation and change terms are supplier-specific and will be disclosed to you in writing at the time of booking, wherever available. Many travel bookings are subject to full or partial non-refundable deposits, cancellation fees, or change fees set by the supplier — not by the Agency.
Where a supplier's policy allows for a refund, we will process your refund request promptly upon receiving funds from the supplier. Processing timelines depend on the supplier and are outside our direct control.
Any Agency service or planning fee (where applicable) is separate from supplier costs and its refundability will be disclosed to you in advance in writing.
We do not represent that any booking is refundable or non-refundable in absolute terms; you will always be advised of the specific, applicable policy for your itinerary before you pay a deposit.
6. Travel Insurance
We strongly recommend that all clients purchase comprehensive travel insurance, including coverage for trip cancellation/interruption, emergency medical care, and baggage loss, at the time of booking. Travel insurance is optional unless required by your destination or supplier, and declining coverage is done at your own risk. If you decline insurance, we may ask you to confirm this decision in writing.
7. Travel Documentation & Eligibility
You are solely responsible for ensuring you and all travelers in your party hold:
Valid passports (with the minimum validity required by your destination)
Any required visas, transit documents, or electronic travel authorizations
Any required vaccination, health, or entry documentation
We will provide general guidance where possible, but we are not liable for denied boarding, denied entry, or travel disruption resulting from missing or invalid documentation.
8. Health, Safety & Travel Advisories
We may reference Government of Canada travel advisories and supplier health/safety requirements in our recommendations, but you are responsible for reviewing current advisories for your destination prior to departure and making your own informed decision to travel. If you disclose health, mobility, or accessibility needs to us (see our Privacy Policy, Section 2), we will use that information solely to help identify suitable travel arrangements, and we make no guarantee that every supplier can accommodate every request.
9. Force Majeure
The Agency is not liable for failure to perform, or delay in performing, any obligation due to events beyond our reasonable control, including but not limited to natural disasters, extreme weather, pandemic or public health emergencies, government action, civil unrest, strikes, or supplier insolvency. Where such events affect your travel, we will assist you in navigating the applicable supplier's policies, but any resulting costs, losses, or refund limitations are governed by the supplier's terms, not the Agency's.
10. Limitation of Liability
To the fullest extent permitted under Ontario law:
The Agency's total liability for any claim arising from our services is limited to the value of the Agency service or planning fee paid to us directly (excluding funds passed through to suppliers).
We are not liable for indirect, consequential, or incidental damages, including loss of enjoyment, missed connections, or trip interruption caused by third-party suppliers.
Nothing in this section limits liability that cannot be excluded under applicable Ontario consumer protection law.
11. Payment Card Authorization & Chargebacks
Where you authorize a payment via our Supplier Credit Card Authorization form, you confirm you are the authorized cardholder (or have the cardholder's explicit permission) and agree to the charge for the specific booking described.
You retain your full legal rights under your card issuer's chargeback policies and applicable law. We do not require you to waive or restrict your chargeback rights as a condition of booking. However, initiating a chargeback for services that were properly rendered as booked, without first contacting us to resolve the issue, may delay resolution and affect our ability to assist you with the supplier directly. We encourage you to contact us first with any billing concern.
12. Client Responsibilities
You agree to:
Provide accurate, complete, and timely information for all travelers
Review and confirm all itinerary and booking details upon receipt
Notify us promptly of any errors, changes needed, or concerns
Comply with the conduct, safety, and check-in requirements of each supplier
13. Complaints & Dispute Resolution
If you have a concern about our services, please contact us directly first at hello@christinestraveltherapy.ca so we can work toward a resolution. Complaints regarding a specific supplier's product or service should also be directed to that supplier directly, as they are the responsible party for that portion of your trip. Unresolved complaints relating to our conduct as a registered Ontario travel agency may also be directed to TICO.
14. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
15. Amendments
We may update these Terms from time to time to reflect changes in our practices, supplier requirements, or legal obligations. The "Last Updated" date above reflects the most recent revision. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
